A 55-year-old man has been arraigned and charged with incest contrary to section 20(1) of Sexual Offences Act No. 3 of 2006 under the Kapenguria criminal case number E029 of 2024.
Benjamin Rotich Limasia was charged that on October 1, 2024 at around 1900 hours at Sarmach village in Pokot Central Sub County in West Pokot County, he intentionally defiled a child aged 12 years who is his own daughter. On the second count, the accused was charged for committing an indecent Act with a minor contrary to section 11 (1) of the Sexual Offences Act, 2006.
The accused pleaded not guilty to the charges before Kapenguria law court Principal Magistrate Stella Telewa on Tuesday October 15, 2024. The accused took the plea, the court had ordered that he be taken to hospital for mental assessment and the medical report said that the accused was suffering from alcohol withdrawal and that he had mental issues.
The prosecutor told the court that the plea could be taken. The court noted that the substance of the charge and every element thereof was stated by the court in the language that the accused understood. When the accused was asked whether he admits or denies the truth of the charge, he responded by saying that the claim was not true.
The magistrate ordered the accused for both counts to be released on a bond of Sh200,000 with one surety. The magistrate further ordered the case to be mentioned on October 22, 2024 for pre-trail.
