A 40 year old herdsman, 40 accused of  defiling a 12 year old girl has fervently pleaded with Nyahururu law court for his release citing he has suffered enough in remand and is an orphan.

However, the court assured William Chesang Chebii that his case would be expedited fairly and decision to release him or not to be reached once the case is heard and determined. Chesang who appeared before Chief Magistrate Evans Nezekiah is said to have committed the offence on February 25, this year at Ngoru village in Nyahururu Sub County.

Particulars of the offence are that on the material day at around 1.00pm the victim met her assailant, an employee of their neighbor while grazing as she was on her way to water cows at a nearby river. The accused followed the minor, grabbed her hand and dragged her into the nearby bush, threatening to kill her if she screamed before defiling her.

A woman who was passing by caught the accused on the act and screamed at him before he vanished into the bush. The girl was escorted home then the matter reported at Marmanet police station before she was escorted to nearby healthcare facility for medical examination as a search of the assailant commenced.

According to Ephraim Kigunda, investigating officer attached at Marmanet police station, after a thorough search of the accused, they were informed the accused had gone into hiding at his sister’s place in Tuyapei village, Baringo County after committing the offence.

However, police while working closely with local administration in Tuyapei, arrested the accused and was taken to Marmanet police station where he was charged with the offence before being arraigned in court where he denied the allegations.

The matter was set for further hearing on September 19, 2024.
