All judicial proceedings in Samburu County are likely to take place at the Maralal law courts after judicial officials resolved to put a stop to open court sessions.
The Executive Council, National Council of the Kenya Magistrates and Judges Association (KMJA) and the leadership of the Kenya Judges Welfare Association, Kenya Judicial Staff Association (KJA) on Sunday resolved that they will not conduct any Judicial proceedings in the open air whether under a tent, containers, any makeshift structure or otherwise.
Members of the KMJA and KJA said that they shall only conduct judicial proceedings from professionally approved buildings putting a stop to open court judicial proceedings. The resolution came after Principal Magistrate Monica Kivuti was shot and killed while on duty in a makeshift tent at the Makadara law courts on Thursday last week.
A judicial staff who sought anonymity told KNA that Samburu County has only one professionally approved court building in Maralal town and the resolutions by KMJA and KJA will paralyse court proceedings in Samburu North and Samburu East sub counties.
“With the absence of open court proceedings which we carry out twice a week, all matters from the vast Samburu County will be heard at the Maralal law courts. And Samburu being a hardship area, this will lead to delayed cases and also strain witnesses.” The staff noted.
