High court bars Meru MCAs from debating impeachment motion

The Meru High Court has halted the debating and voting of an impeachment motion against Governor Kawira Mwangaza, which was expected to be her fourth impeachment in two years.

Justice Linus Phogon Kassan, while halting the process said the court will issue further directions on Monday, July 29, after going through the responses of all the opposing parties to ensure a fair and just process.  However, the MCAs will not face any prejudice due to his decision to halt the process.

Through her advocates Elias Mutuma and Ashaba Mark, the governor had gone to court to stop the impeachment process with arguments that the motion was flawed and sponsored by her usual political detractors. The Governor alleged that the legislators were being whipped along political lines to impeach her to settle political scores.

Meanwhile, Justice Kassan noted that this was the fourth time that the petitioner is facing impeachment, with the other three previous attempts failing to go through. “It is in the interest of the public that the petition is decided at this stage to pave the way for a future smooth process because so far, resources and judicial time has been spent,” said Justice Kassan.

At the same time, a section of MCAs that has been supporting the Governor led by former Assembly Majority leader Evans Mawira called on their colleagues to drop their hard-line stands and embrace dialogue for the sake of service delivery to the county residents.

As leaders, we don’t want to continue with these issues of impeachment every time. We need to sit down and have a working formula with the Governor for the sake of our county’s development,” said Mawira. The MCAs said it was high time they kept their differences aside, and came together to reason as a team.
