Assault
A man who attacked two of his neighbours while armed with a knife has been arraigned in a Kabarnet court charged with assault. Evans Chesire is alleged to have committed the offences on June 6, 2024 at Kuikui location in Baringo North Sub County in Baringo county while armed with the dangerous weapon.
The first count stated that on the material day, he willingly and unlawfully assaulted Walter Chelibei causing him actual bodily harm contrary to section 251 of the penal code. The second count stated that on the same date and place the accused punched Jeniffer Chesiret on the face as he threatened to kill her while armed with a sharp kitchen knife.
When the two charges were read to Chesire before Principal Magistrate (PM) Purity Koskey, he denied any wrongdoing claiming that he did not threaten nor assault anyone since he is a good man.
An eyewitness, Alphonse Chemitei, in a statement told the court that members of public saved the lady after raising an alarm and tying the man using a rope before calling police officers who rushed to the scene where they arrested and escorted the assailant to Kabarnet station for interrogation and subsequent arraignment in court.
The prosecution counsel Patrick Ogutu did object to the accused being granted bond terms stating that his team was ready to mount a case upon receiving a duly filled P3 Form and statements by the investigating officer and two key witnesses.
Ruling, PM Koskey ordered the man to be released on personal bond of Sh30,000 with one surety or cash bail of Sh 10,000. The magistrate slated the case for mention on June 28, with hearing on July 16.
