Man in court for biting police officer’s arm

A man who attacked a police officer by biting his arm while arresting a changaa brewer has been arraigned before a Kabarnet court charged with assault.

Anderson Amdany Chelimo is accused that on May 22, 2024 at Kabilany village in Baringo North sub county within Baringo county, he willfully and intentionally assaulted PC Samuel Muchiri No. 250905 and PC Felix  Mwatu No. 118611 by biting PC Muchiri left arm while in due exercise of their duty of arresting an illicit brewer, Bramson Rotich.

The accused faced a second count of escaping from lawful custody while being handicapped contrary to section 123 as read with section 36 of the penal code.

Chelimo who appeared before Principal Magistrate (PM) Purity Koskei and charged with assaulting the police officer in due line of duty contrary to section 103(A) of the National Police Service Act No.11(A) of 2011 pleaded not guilty to the charges preferred against him claiming he was not involved in any act of assaulting the police officers.

“Your honour, I did not bite the police officers intentionally as I was drunk when they were arresting a brewer. Your honour I also did not escape from lawful custody as stated,” Chelimo said while defending himself.

Prosecution counsel Patrick Ogutu supplied to the court copies of statements of PC Samuel Muchiri, PC Felix Mwatu and PC Mark Odhiambo promising to also present medical documents in the next mention date.

In her ruling, Principal Magistrate Koskey ordered for a pre-bail report in view of the second charge of escaping from lawful custody to assist the court to determine if bond terms can be granted to the accused.

The magistrate ordered the case to be mentioned on July 23 when further orders will be issued.
