Meru High Court convicts man over murder

The Meru High Court has convicted a man accused of murdering a human rights activist over a land dispute in January 2022. Patrick Naweet, a security guard, is said to have stabbed the Isiolo-based Elizabeth Ekaru severally resulting in her death.

Presiding Judge Edward Murithi Friday ordered Naweet to present his mitigation report to the court before sentencing. Murithi said the prosecution led by Eric Masila through eleven witnesses had proved beyond any reasonable doubts that Naweet intentionally murdered the activist.

He exonerated the late Ekaru from defense claims that Naweet acted in self-defense after being overpowered when she sat on him, strangling him. He said there was no direct evidence of an attack on the accused, but there was evidence of struggle between the two according to the investigating officer.

He termed the attack ‘ferocious,’ adding that the five deep stabs were unnecessary. “There is no evidence the deceased attacked the accused with any weapon. There is also no support from photos of him being hurt with a stone as the defense claimed. Why multiple stabbing?” posed Justice Murithi.

He added: “I find the accused guilty of the offense of murder. The Prosecution proved beyond reasonable doubt that Naweet murdered the deceased against cause and I convict him. I order for mitigation and pre-sentencing report. The accused is to be remanded until the date for sentencing,” Justice Murithi said.

Defense lawyer Hillary Mugambi had passionately asserted Naweet’s innocence, claiming that his action was an act of self-defense provoked by circumstances. Prosecution Counsel Erick Masila had painted a vivid picture of the crime scene, emphasizing the excessive force used by the accused.

“The multiple injuries inflicted on Ekaru’s thighs and hands indicated that she had desperately shielded herself from repeated attacks. Consistent and credible testimony from several witnesses, all point to Naweet’s culpability,” said Masila.

The accused is in remand at the Meru GK prison, awaiting his sentencing on September 5, 2024.
